State ramps up Act 757 enforcement to overcome strata management crisis

SHAH ALAM, Aug 12 — The state government, through the Selangor Housing and Property Board (LPHS), is improving strata development governance as a long-term strategy to overcome the critical problem of maintenance fee collection.

State executive councillor for housing and culture Datuk Borhan Aman Shah said this involves further enforcing the Strata Management Act 2013 (Act 757) and empowering joint management body (JMB) and management corporation (MC) capabilities.

“LPHS is improving strata management compliance and digitalisation using the e-COB system, awareness programmes for lot owners, and employing star ratings to encourage more efficient and professional management practices.

“Strengthening Act 757 is through guidance and action by the Commissioner of Buildings (COB) on lot owners who fail to pay maintenance charges,” he explained in response to Bukit Gasing assemblyman Rajiv Rishyakaran’s query about a list of local authorities without strata management schemes at the Selangor State Legislative Assembly sitting here today.

Borhan added that there are 310 strata schemes, involving 35,817 lots, without functional JMBs, MCs or management agents, based on COB’s records statewide.

“This stems from several factors … (such as) low maintenance fee collection rates and governance weaknesses, (and) the lack of lot owners’ participation and awareness about their shared property management responsibilities.

“Legal and administrative issues also lead to strata management processes not being carried out effectively,” he said.
