SHAH ALAM, June 23 — The Kuala Selangor Municipal Council (MPKS) has imposed a RM125,000 compound fine on a strata property developer in Puncak Alam for failing to convene the first annual general meeting (AGM) of the management corporation (MC).
The action, carried out through its Commissioner of Buildings (COB) Unit, followed an investigation on June 4, which found that the transfer of strata parcel ownership had reached 25 per cent of the total aggregate share units.
“However, the developer failed to fulfil its obligation to convene the meeting despite several notices and reminders issued by the MPKS COB Unit.
“Following the investigation, the investigation papers received approval for a compound notice from the Deputy Public Prosecutor, and a compound penalty was imposed under Section 57(2) of the Strata Management Act 2013 and the Strata Management (Compounding of Offences) Regulations 2019,” it said in a Facebook post.
MPKS remains committed to ensuring compliance with strata management laws and will continue to take firm action against parties that fail to meet statutory requirements.
Under Section 17(3) of the Strata Titles Act 1985, building management responsibilities must transition to the MC once 25 per cent of strata ownership has been transferred to purchasers.
Developers are also required to convene the first AGM to establish the joint management body within one year of delivering vacant possession to buyers.
