SHAH ALAM, July 16 — The Subang Jaya City Council (MBSJ) has imposed a RM15,000 compound fine on seven individuals, including the chairman and committee members of the Empire Subang Management Corporation (MC), for failing to hold an Annual General Meeting (AGM) for 2024.
The compound was issued on May 6, following a complaint received by MBSJ's Commissioner of Buildings Department.
It said that the investigation's findings were subsequently referred to the Deputy Public Prosecutor, who approved the compound action.
"The compound action was taken under the First Schedule, Compoundable Offences, Strata Management (Compounding of Offences) Regulations 2019, read together with Subsection 135(2) of the Strata Management Act 2013.
"Under this provision, the Commissioner may impose a compound not exceeding 50 per cent of the maximum fine prescribed for the offence," MBSJ said in a statement today.
Notices of the compound offer had been issued to the individuals concerned, who were given 14 days to settle the payment.
The local authority added that prosecution proceedings may be initiated if the compound is not paid within the stipulated period.
"In addition, upon conviction, the individuals concerned may be fined up to RM50,000, imprisoned for a maximum of three years, or both, under the Strata Management (Maintenance and Management) Regulations 2015," it said.
In this regard, MBSJ urged all Joint Management Bodies and MCs that have yet to hold their AGMs to fulfil their statutory obligations as required under the Strata Management Act 2013 without delay.
It said that AGMs serve as the primary platform for strata property owners to discuss and make decisions relating to the management and maintenance of their buildings.
"The proper conduct of AGMs not only helps resolve management issues but also ensures the continued welfare and well-being of strata communities," MBSJ said.
