SHAH ALAM, AUG 8 — Selangor State Legislative Assembly Speaker Lau Weng San will decide the status of Selat Klang state assemblyman member Datuk Abdul Rashid Asari after reviewing details, including obtaining confirmation from the Malaysian Insolvency Department.
Menteri Besar Dato’ Seri Amirudin Shari said the matter was within the Speaker’s jurisdiction, including to conduct investigations and obtain relevant information before making any decision.
“I believe the Speaker will call him, conduct a review with the Insolvency Department and confirm his position and then Weng San will announce it later,” he said during a media conference after tabling the Second Selangor Plan in the Assembly sitting at the State Secretariat Building yesterday.
Amirudin added that any decision on a seat vacancy also depends on the Speaker, while in the event of a vacancy, election matters are under the Election Commission's jurisdiction.
Yesterday, the High Court reportedly annulled the bankruptcy order against Rashid after allowing his application under Section 105 of the Insolvency Act 1967.
Based on a court order dated August 7, the bankruptcy order imposed on April 1 was annulled, while the costs of the application were borne by the judgment debtor.
The application was filed by Rashid as a judgment debtor against the Employees Provident Fund Board as a judgment creditor.
Previously, there were media reports stating that a state assemblyman had been able to avoid vacating his seat following the revocation of the bankruptcy order.
