SHAH ALAM, Oct 29 — Malaysian Border Control and Protection Agency (AKPS) director-general Datuk Seri Mohd Shuhaily Mohd Zain will return to the police force after the government decided to end his secondment to the agency.
Home Minister Datuk Seri Saifuddin Nasution Ismail said the decision was made last week.
"The decision to return him from his secondment at AKPS to the police force has been made," he told reporters after attending the Home Ministry's monthly assembly in Putrajaya today, Berita Harian reported.
Shuhaily, the former head of Bukit Aman's Criminal Investigation Department, was seconded to AKPS as its director-general on July 1 last year.
Yesterday, Inspector-General of Police Tan Sri Mohd Khalid Ismail said the status of Shuhaily's service at AKPS had been referred to the Attorney-General's Chambers (AGC) for legal advice before a decision on whether to terminate or shorten his tenure was submitted to the Yang di-Pertuan Agong for consent.
"We referred the matter to the AGC because Shuhaily's assignment to AKPS is for a two-year term. It is like a contract, and the contract was made with the consent of the Agong.
"Should any issues arise involving suspension from duty or other matters, our actions will depend on the AGC's advice. However, any decision concerning the termination of the contract must be submitted to the Agong for consent," Khalid said.

On October 21, Shuhaily pleaded not guilty to two charges of voluntarily causing hurt to two police personnel at KLIA on September 28, after the charges were read out before Magistrate Khairatul Animah Jelani.
The charges were framed under Section 323 of the Penal Code, which provides for imprisonment of up to one year, a fine of up to RM2,000, or both.
Shuhaily was accused of voluntarily causing hurt to Mohamad Faiz Saman and Muhammad Ekmal Sofwan Dirman near Counter J, Level 5, Terminal 1 of KLIA between 1.27 pm and 1.35 pm on September 28.
