SHAH ALAM, Jan 2 — A total of 605 written warnings with fines amounting to RM144,450 was issued to individuals who flouted the smoking ban at eateries, which was enforced nationwide yesterday.
Health Ministry director-general Datuk Dr Noor Hisham Abdullah said 2,087 enforcement officers from the ministry were involved in the inspection of 6,119 eateries across the country.
"The response following the smoking ban is very encouraging and I hope the public takes collective responsibility in ensuring the ban can be enforced effectively even if there is no standing officer constantly monitoring.
"The operation also saw 103 written notices amounting to RM25,750 issued to owners of the eateries.
"The ministry has always respected smokers’ right but advised them to smoke at appropriate places as the government aims to nurture a civilised culture among Malaysians," he said in a statement today.
Noor Hisham pointed out that the ministry’s officers will be monitoring all no-smoking areas, including eateries, which come under Regulation 11 (1) (d) of the Tobacco Control Regulation (PPKHT) Regulations 2004 (amended) 2018.
Those caught smoking in no-smoking zones will be issued a RM250 compound.
The fine can be reduced to RM50 for the first-time offence that is settled at the district health office within a month of the compound being issued.
No reductions would be given for the second-time offence and the amount is to be paid in full.
Third-time offenders would have to pay a compound of RM350.
Under the new ruling, eatery owners must ensure that their premises are completely smoke-free.
They are also prohibited from providing amenities for smokers, such as ashtrays or shisha services.
Proprietors must also ensure that the "no smoking" sign is displayed prominently and clearly in an area visible to all.
Failure to comply with the ruling can see business owners issued a compound of RM250 for the first and second offences, and RM350 for the third offence.
