The intention of this letter is to bring the matters below to your attention:
- The issue of reappointment of the two judicial posts announced by the Prime Minister’s Office on July 7, 2017, violates the Constitution.
- The person in the post of Chief Justice or President of the Court of Appeal cannot be extended to hold the position upon reaching the age of 66 years and 6 months.
- In view of the reappointment, which according to the Constitution was made by Your Majesty (as advised by the Prime Minister), hence you are the rightful person to present this matter to be decided by the Court before it takes effect.
- The reinstatement of the Chief Justice position held by YAA MD RAUS SHARIF will commence in two days which is on August 4, 2017.
- If this matter is not addressed immediately, it will create a JUDICIAL CRISIS as all trials or decisions after August 4, 2017 will be NULL AND VOID.
In fact, the judicial administrative system run by the Chief Justice will be DEFORMED as it will be run by an illegitimate judge according to the constitution.
- According to Article 130 of the Federal Constitution, it is only Your Majesty who can make REFERENCE on judicial issues to be determined by the Federal Court.
- This is to ensure that Your Majesty would be able to protect Malaysia’s constitutional sovereignty from being tarnished, in the interest and well-being of the COUNTRY and YOUR CITIZENS.

Today, we have presented to Your Majesty to bring to your attention several issues as follows:

- According to Article 130, it is only Your Highness who can make REFERENCE to judicial issues to be determined by the Federal Court.
- Hence, all of us representing the four parties in the PAKATAN HARAPAN coalition, through this letter, urge Your Majesty in your discretion to refer to the Federal Court on whether the reappointment is valid or otherwise.
- This is to ensure Your Highness is able to protect Malaysia’s constitutional sovereignty from being tarnished, in the interest and well-being of the COUNTRY and YOUR CITIZENS.
